don't worry. divorce is possible with the consent of both the parties. you will get the opportunity of being heard.if ur reason is genuine divorce is not possible.normal dispute can be resolved by counselling. ask your wife for refering counselling.

prefer counseling. why to take the personal matters into court. all these kinds of issues can be solved through counselling or mediation. sharing family matters with her father is undoubtedly a wrong thing but being an advocate I suggest that both the parties should get the opportunity to be heard.

Hindu minority and guardians Act,1956.section 6 describe the custody of the child. if the child is below the age of 5 years, court would prefer to give custody of the infant to her mother.as such, no Act specifies the sole custody of the child to the mother.but for the welfare of the child, it is preferable to give custody to her mother.

visit the notary or an advocate near you. he will have a draft of such an affidavit. then you are required to submit the documents like adhar card, passport size photo. both the parties are required to sign on that affidavit.

Q: Family issue and filing for divorce

My young brother was married last Aug 2024. Since his marriage, there are number of issues arising. Girl is not very keen in family life and doesn't gel with my brother. Private time in bedroom is also not good. She is not interested in any physical relation or any family planning. She even doesn't talk with my brother much in house or if they are outside. She said that she was not ready for marriage and her parents asked her to marry. Not taking any house responsibility unless asked to.

you can file a divorce petition on the grounds of restitution of conjugal rights as wife is not interested in making any kind of physical relationship and in marriage, it is the right of both the parties to have sexual intercourse with their partner.
