Q: How to get the accused arrested, if court has granted him bail

A person had attacked my brother and on our complain police levied 307 ipc on him. Courts have refused to Grant him bail. As a complainant what should I do to get the accused arrested?

u can give the petition to the superior officer that he is roaming free and threatening me and in mean time give the petition for report in the case related before the additional chief judicial magistrate or chief judicial magistrate, so that the magistrate asked for report from the concerned police station about development of the case.

Q: Maintenance to wife staying at her parent's home with child.

I was trying to give my son's name through municipality ..but I failed many times ..one day I came to know my son's name already given by her home..the municipality employee laugh at me and told me ugly statement..then I rebuked her in phone..from then nine months over with my one year old son till now she didn't contact with me with my o..I would not call her..now I want to divorce her..I am a sategovt employee nd salary is approx 18k..how much allowance would I have to give her ???what and should I do??

before coming to a decision i would rather tell u to give notice for return of ur wife by any lawyer, then filed the section 9 of the restitution of conjugal life if she refuse then u filed divorce and ward and guardian act for visiting right of the child

Q: Regarding partition of ancestral property among all the brothers

Sir, my grandfather died a month before. Also I lost my father in 2005. My grandfather was having 6 children i.e 4 daughters (1dead) and 2 son (1dead--> my father). My father had two sons and my Tauji is also having 2 sons. Now my cousin brothers are denying to divide the property into 4 parts. They are hiding the death certificate of my grandfather and also the original papers of the land and ration card. They are saying that we had misplaced it. I inquired into the registration department by providing the khasa katra (plot nos) It's still in my grandfather's name. Please suggest how to claim my share in my grandfather's house. Also will partition happen only among 2 ( my father and mu tauji) or it would happen among all 6 i.e including my fua's too. Also please explain the process of transferring the house from my grandfather's name into my name?

u can file partition suit against other co sharer and for that urcertified copy of grandfather deed , father dead certificate , grand father death certificate is required and for mutation in ur name u have to give a judicial affidavit to the concerned authority for ur name and other co sharer

Q: Divorce Filling Process in case other party did not receive notice

I have filed divorce on June 2017. First date was on November. On that I came to to know that my opposition party still did't receive any official summon. So nobody came from opposition side. Then I have been informed that on Jan 2017, there is another on that date again summon will be sent to my opposition party. So what I understood that it is more than 7-8 months I have filed divorce but my opposition party does not know that. My lawyer is saying it is normal but I have doubt on that. Can anybody suggest me weather this is normal process.

U HAVE to sent the summons again if she refused to accept then ur case will exparte,if she will receive thesummons then ur matter will be contested, if she donot receive summons then u have to file petition order 5 rule 20 for paper publication then ur matter will be in a right procedure, but ur question is somehow confusing with the date.

Q: How to install grills in the house when the contractor is not doing it

I have a 2BHK flat in North 24 Pgs. purchased during 2011 and registered during 2015 . We had multiple issues with the promoter from time to time however, consumer case raised by few persons helped us to get our flat along with 60-70% completion of the overall project . After consumer cases have been settled, the promoter attitude again back to previous state . Recently, when I requested to install Grills outside windows and balcony they are not providing me any specific date for last 15 days even after follow up and mails . I came to know that they didn't clear payment to the Grill contractor and thus the contractor is not working further. At the same time, they are not allowing me to get this installed by myself . I heard that they did not allow anybody earlier . In this circumstances, can I get the grills installed at my own arrangements ? will there be any legal issue in future ?

u should give the lawyer notice to the promoter, then file the case in the consumer forum, before that give the letter to the concerned police station stating the current position and security condition for not installing grills by the promoter and also give the letter to the councillor.
