When Crl.M.P. of 2026 filed under Section 319 Cr.P.C. has remained pending for respondent-side arguments/enquiry since may 2026 and has been repeatedly adjourned at the request of the respondent side, while the main C.C. case of 2021 has itself been pending since the year 2021, whether the proceedings can be permitted to remain indefinitely pending by repeated adjournments, or filing 309 crpc in next hearing in the interest of expeditious disposal and in accordance with Section 309 Cr.P.C.,

The main case has already been pending since 2021 and the 319 application has been pending since May 2026. Repeated adjournments by the respondent side should not be allowed to delay the matter indefinitely. Kindly take up the application in the next hearing and decide it at the earliest.
Q: Eligibility of Teacher for Gratuity
My wife worked as a regular teacher in an unaided public school at Delhi from 5 Apr 94 to 31 Mar 2001. She had resigned from service due to family reasons. The school did not give her Gratuity at the time of resignation neither she demanded. Can the same be claimed from the school now? The school is still functioning. The Supreme court had upheld the retrospective amendment and extended gratuity coverage to teachers effective from April 3, 1997.
Advocate Rahul Kumar answered
Yes, she can seek gratuity from the school. Since she worked from 5 April 1994 to 31 March 2001, she completed more than five years of continuous service. A formal demand should be made by proceedings before the appropriate authority with an explanation for the delay.
Q: maintenance to divorcee wife and to the child form 1st wife
As per Hindu law what if the father is handicap and is not able to pay the maintenance to the 1st child for divorcee wife and ahs other obligations towards to current family like girl child old mother and mentally unfit sister
Advocate Rahul Kumar answered
Generally, if the father is disabled and genuinely unable to pay maintenance, the court may consider his financial condition, disability and other family responsibilities. His responsibility towards other dependent family members may also be taken into account while deciding the appropriate amount of maintenance. His inability to pay may be considered for an appropriate reduction or modification of the maintenance amount, subject to the facts and circumstances of the case.
Q: Joint property dispute after divorce
After divorce property is in dispute. Wife is paying bank emi for joint property from the date of purchase. Is it possible to make this property on wife's name only. Husband is not paying a single penny in EMI from day one. And even he is not ready to sale property or transfer his share in the property. Can someone suggest me a solution for this issue. The bank loan is still going on, can husband transfer his property on his brother's name.
Advocate Rahul Kumar answered
If the property is jointly owned, the wife cannot make it solely hers just by paying the EMIs. The husband must legally transfer/relinquish his share and the bank’s consent may be required because the loan is still outstanding. If the husband refuses, then you can seek appropriate legal relief from the court. We shall connect to discuss.
Q: How to open defence evidence in pocso rape cade
Can I open the defence evidence stage as I didn't get the chance for defence evidence before the session court. Earlier it was rejected by session court. Can I request in high court do reopen the defence evidence. Case is pocso 6 rape.
Advocate Rahul Kumar answered
Yes, you may approach the Hon’ble High Court seeking reopening of the defence evidence stage, particularly if the accused was not given a fair and effective opportunity to lead defence evidence. The petition can rely on the principles of natural justice, right to fair trial, and prevention of miscarriage of justice. However, the High Court will consider the reasons for the earlier rejection and whether the proposed evidence is necessary for a just decision of the POCSO case.
