This is a serious matter involving harassment and potential threat to a minor girl. I suggest you immediately file a complaint at your local police station under Sections 354 (Assault or criminal force to woman with intent to outrage her modesty), 354D (Stalking), and Section 506 (Criminal intimidation) of IPC. Also, mention that the girl is a minor, which makes it a more serious offence under the POCSO Act. Collect any evidence like CCTV footage, photos, or messages if possible. Police are duty-bound to take immediate action in such cases. If they don't act, you can approach the SP or file a private complaint before the Magistrate.
Q: Asked for a escort service but got scammed by the more than 60000
I called a number where escort service is provided. Initially they said come to my place I will provide you a girl with all the services. Later on that day I lost more than 67000 rupees and still that person never sent any escort service not my money. I got scammed by this person. Do I have the rights to claim the money
Advocate R Sunil Kumar answered
You have been a victim of online fraud and deception. Regardless of the nature of the service, if money was taken from you under false promises, it amounts to cheating and criminal breach of trust under Sections 417 and 420 of the IPC. You should immediately file a complaint with the local Cyber Crime Cell or nearest police station, providing all transaction proofs, chat records, and phone numbers. While recovering the full amount may take legal effort, filing an FIR is essential to initiate the investigation. Do not delay in taking action.
Q: Penalty challan not paid for Drunk and drive
Its been a year now I have not paid the traffic drunk and drive challan. Due to fear of visiting to Court. Now the vehicle RC is at on Police Station. How do I rectify my problem can I still have the chance to pay the challan and get RC. What is the further step I need to take are there any complications. Please let me know
Advocate R Sunil Kumar answered
Yes, you can still rectify the situation. Visit the concerned court where the challan was issued and appear before the magistrate. The court may impose a fine or, in rare cases, a minor penalty, after which the matter can be closed. Once the penalty is cleared, obtain a clearance order and submit it to the police station to retrieve your RC. Delay may result in higher penalties, but resolving the issue voluntarily shows good intent and may reduce complications. It is advisable to consult a local lawyer to assist in court proceedings to ensure a smoother process.
Q: Refund of advance paid against the work
I have paid Rs 16000/- (2800+13200) through PhonePe on 13.5.25 for the work of Excel Cool Coating and Damp proof paint to Deecan Clap (India) PVT Ltd., Hyderabad. They are delaying the work. Hence I requested to refund the amount paid by me. They have not yet refunded the amount.
Advocate R Sunil Kumar answered
You are entitled to a refund if the service is not delivered within a reasonable time. First, send a formal legal notice to the company demanding a refund with interest for deficiency in service. If they still fail to act, you can file a complaint before the District Consumer Disputes Redressal Commission under the Consumer Protection Act, 2019. Keep all payment records, messages, and any communication as evidence to support your claim.
Q: Return of documents from college
I am a btech student i want to discontinue my college in my 1st year my college is not giving certificates back to me instead they r saying to pay whole 4 years fee
Advocate R Sunil Kumar answered
As per UGC and AICTE guidelines, a student cannot be forced to pay the entire 4-year course fee if they wish to discontinue after the first year. The demand is arbitrary and illegal. The college must return your original certificates on request. You can first send a legal notice to the college. If they still refuse, you may file a complaint with the Consumer Forum for unfair trade practices or approach the High Court under Article 226 through a writ petition for violation of your educational rights. Keep all fee receipts and communication as evidence.
