The Applicant has filed an application in 2025 u/s Bharatiya Nagarik Suraksha Sanhita-144.3 against the husband because he is not complying the Order issued to provide Rs. 5000 monthly alimony by Family Court and the matter is still pending. Issues1-What to do to expedite the matter because the Accused is not appearing for second date but he has filed Vakalatnama.2-Pls suggest the best way to solve this matter , we don't want to pursue compromise.

यदि समझौता नहीं करना है, तो निम्नलिखित समानांतर कार्रवाई सबसे प्रभावी रहेगी—*BNSS धारा 144(3) के तहत वसूली एवं दंडात्मक कार्रवाई पर जोर।*शीघ्र सुनवाई हेतु आवेदन।*प्रतिवादी की अनुपस्थिति पर वारंट जारी कराने का आग्रह।*बकाया राशि की संपत्ति/वेतन से वसूली।

यदि वास्तव में विवाह संपन्न नहीं हुआ था और लड़की तथा उसके परिवार ने मिलकर लड़के को डरा-धमकाकर एवं फर्जी दस्तावेजों के आधार पर 20 फरवरी, 2024 को The Uttarakhand Compulsory Registration of Marriage Act, 2010 के अंतर्गत विवाह पंजीकरण करा लिया है, तो ऐसे पंजीकरण को निरस्त कराने की क्या कानूनी प्रक्रिया है? लड़की ने शपथपत्र में यह घोषित किया है कि उसकी कभी शादी नहीं हुई वह अविवाहित है, जबकि लड़की ने पूर्व में एक अन्य व्यक्ति से तलाक लिया था। तलाक संबंधी न्यायालय के आदेश की प्रमाणित प्रति भी उपलब्ध है

इस मामले में मैं निम्न क्रम अपनाने की सलाह दूँगा—विवाह पंजीकरण निरस्तीकरण एवं घोषणा (Declaration) हेतु सिविल वाद दायर करें।साथ में अंतरिम निषेधाज्ञा (Temporary Injunction) मांगें ताकि विवाह प्रमाणपत्र का किसी भी उद्देश्य से उपयोग न किया जा सके।समानांतर रूप से पुलिस/मजिस्ट्रेट के समक्ष आपराधिक शिकायत दायर करें।मेरी राय में, यदि वास्तव में विवाह कभी संपन्न नहीं हुआ और पूर्व विवाह/तलाक के प्रमाण उपलब्ध हैं, तो यह मामला केवल विवाह पंजीकरण रद्द कराने तक सीमित नहीं रहेगा, बल्कि गंभीर आपराधिक धोखाधड़ी का मामला भी बन सकता है।
