3 month back my friend stole an signed cheque and now he presented to bank that was bounce ( in the same day when I got know cheque was stolen I immidiate called the bank and stop the cheque ) now he send me a legal notice to pay the amount What action I can take in this situation.

If the cheque is really stolen, lodge a complaint in police station. And collect FIR of the same and reply to notice with the help of an advocate . Unless you take action against theft of cheque, Courts will not consider your version.

Not necessary. If the property was self acquired, he is free to do anything with the property without anyone’s consent. He can Gift the property to anyone he likes. If the property is ancestral, then he can gift it only to the extent of his share in the property

Loan given to brother by cheque can be recoverd in case if he refuse to give back how long it will take to recover.

Do you have any pro-note or bond in that regard?? If so it will be easy. Else you need to prove that the money transferred to your brother was a loan. You need to file a case for recovery of money alongwith details of cheque issued. And you need to pay Court fee defending on your claim amount.
