Questions Answered by Advocate Nitesh Kumar Chaurasia
Q: Written Statement after death of defendant
When a defendant dies, can his legal representatives amend his written statement? Or, should they file fresh written statements? Does the limitation begin from the date of their impleadment into the suit? Do they have to file all the documents? In the case of plaintiffs, they keep amending the same plaint when a plaintiff dies, but why do defendants have to file new written statements when a defendant dies?
Advocate Nitesh Kumar Chaurasia answered
Under Order XXII Rule 4(2) CPC, the legal representatives (LRs) of a deceased defendant are not automatically required to file a fresh written statement if the deceased defendant had already filed one. They can ordinarily adopt and rely upon the existing written statement. However, they may seek the Court’s permission to file an additional or amended written statement, subject to the applicable procedural rules and the stage of the proceedings. If the deceased defendant had not filed a written statement, the LRs may seek permission to file one, but their substitution does not automatically entitle them to a fresh opportunity to file it irrespective of the stage of the suit. There is no general requirement to refile all documents already forming part of the judicial record. The LRs may rely upon the existing record, while any additional documents must be filed in accordance with the applicable procedural requirements. The position is not fundamentally different merely because the deceased party was a defendant rather than a plaintiff. The existing plaint ordinarily continues after substitution of the plaintiff’s LRs, just as the existing written statement ordinarily continues after substitution of the defendant’s LRs. Any amendment or additional pleading must be considered in accordance with the CPC and the facts of the particular case. The precise course of action will depend on whether the deceased defendant had already filed a written statement, the stage of the proceedings, and whether the LRs seek to introduce any new or additional defence.
