At first you have to take divorce from your wife.. without taking divorce, you cannot marry another woman as per Hindu law.. The court will pass a decree for divorce and by that decree your marriage will be dissolved with your first wife.. then you may marry another woman and live together.. Q: Seeking help regarding a false 498A case filed by my wfe
My wife filed a FIR u/s 498A against me on 26.07.2022. Charge sheet is not filed yet. It is false case. Actually me wife does not want to stay with my mother and wants to leave with me in a rented house and refused it. That why she filed the case against me and my mother. My wife is residing in the paternal home since 10.07.2022. Moreover, we have a 4.7 years old son who is with his mother. Kindly guide what to do..Regards

File a petition for Restitution of Conjugal Rights, if you want to bring her back. Moreover you need not worry about the 498A case.. even if the case will be charge sheeted, you will not be convicted, unless your wife proves her case in the Court. I myself Badika (girl) belongs to Hindu religion loves a guy Aditya (boy) from same religion Same caste (Hindu and Marwari) . Hi Badika.. The issue which u r facing now, it's not a problem.. As far as Marriage is concerned, it's totally your own decision, whom to marry and when to marry.. Nobody can force you on this.. If you are not ready yet for getting married, tell your parents about the same.. They cannot force you to get married if you are not ready..

The question is whether you want to bring ur wife back to ur home? If yes, then first of all, you contact a lawyer and send a legal notice for restitution of conjugal rights through ur lawyer and demand ur wife to come back and join ur company.. If ur wife doesn't come back or sends u a negative reply, then you may file a suit for restitution of conjugal rights and bring her back. Thanks.. Hope this will help you..

hi.. i have gone through your query. As far as a petition for Maintenance is concerned, a person (being the wife, children, father or mother) of a man, who is unable to maintain himself or herself, can claim maintenance from that person. In your case, you are a Government employee and drawing a handsome salary and as such you are very much able to maintain yourself. But you can claim maintenance for your daughter from your husband, who is legally bound to maintain his daughter or else provide maintenance for her. Thanks.
