Q: Father Giving All Property To Step Mother
Sir I Mohd Qadeer frst son of my father ,my father divorceed my mother and I was living with my father now my Father is giving all property and house to my step mother how can I claim my share in house and property as I am still living in this house, ancestral property and I am muslim
Advocate Mudasar Ahmad Dar answered
your father has absolute powers to elinate his property what ever he wished to do u cant restain him bit there are some sutations where your rights can be protected .Being a Muslim, .succession rights generally arise upon the death of the owner. If your father transfers property through a valid gift (Hiba) during his lifetime and fulfills the legal requirements of gift under Muslim law, such transfer may be valid. You should first obtain and examine the revenue records, title documents, mutation entries, and details regarding the nature of the property (ancestral or you may send further details self-acquired). Based on those documents, appropriate legal proceedings can be initiated to protect your rights.
Q: Cctv camera installed by neighbour making continuously beeping Noise
A neighbour has installed a cctv camera and it is making high frequency beeping noise which is all over my house and it is continuously making noise sometimes and it's like very irritating and we told them many times they got angry and they keep ignoring my request to turn it off. Cctv camera is not pointing towards my property but that beeping sound is continuously effecting my mental health i am getting aggressive
Advocate Mudasar Ahmad Dar answered
you may file a complaint in court of law ,If the CCTV camera is emitting a continuous beeping sound that is causing substantial disturbance and affecting your peaceful enjoyment of your property, the issue may amount to a private nuisance. Even if the camera is not directed towards your house, the owner cannot create unreasonable noise that interferes with neighbouring residents. You should first collect evidence, such as audio/video recordings of the noise and statements from other affected neighbours, if any. Thereafter, you may submit a written complaint to the local police station or the competent municipal/local authority seeking redressal of the nuisance. If the problem persists, you may also seek an appropriate injunction and other reliefs before the competent civil court to restrain the continuation of such nuisance. The remedy will depend upon the intensity, duration and effect of the noise on ordinary residential life.
Q: Gift deed by a donar to his children
Is gift deed having any legal status if the the donar writes an application to tahsildar that he made it under force and pressure thus not allow it's mutation
Advocate Mudasar Ahmad Dar answered
If the donor later submits an application before the Tehsildar alleging that the gift deed was executed under force or pressure, the revenue authority ordinarily cannot cancel or declare the gift deed invalid. Mutation proceedings are only for fiscal purposes and the Tehsildar has limited jurisdiction; he cannot adjudicate complex questions of title or validity of a registered document. If the donor claims coercion or fraud, the proper remedy is to file a civil suit for cancellation of the gift deed before a competent civil court. Until a civil court sets aside the registered gift deed tensile dar can't set aside the gift deef he has no power to heard the validity of of this deed it can only be challenged though civil court
