Questions Answered by Advocate Manisha Shelar

Q: my age is 21 running i can marriage with divorce women on the running

my age is 21 running i can marriage with divorce women on the running???????????????????????????????

Advocate Manisha Shelar answered
No you cannot marry at the age of 21 running. The law has prescribed the age to get married at or above the 21 years of age, which means 21 complete, not running. I would suggest to wait till you're 21, to avoid any illegality in marriage and to save yourself from future inconvenience.

Q: My gold and my wife's gold is with her sister and she is not returning

My wife and I have kept my gold with my wife's sister due to home renovation and she kept in her bank. Now my wife died in a road accident, and my wife's sister is not returning the gold of mine. Also my mother-in-law has given gold to my wife which she has kept with her sister in bank, and she is not returning the same to me. I dont have the original bills of my gold due to home renovation I lost the same. How can I claim the gold of my wife from her wife's sister. What should I do and i am really worried as my gold was to be given to my daughter 9 years old after her marriage. Please help me.

Advocate Manisha Shelar answered
You can file a police complaint against her and but as you don't have the original bills of the jewelry, you tell your wife's sister to prove that the jewelry belongs to her by showing the bills to the police. Visit the jewelry shop if all the jewelry has been purchased from the same shop and ask them to help you out. Find your wife's pictures where she is wearing all those jewelry.

Q: Want To File A Case On A Guy Who Cheated And Said With Marry Me.

Earlier he use to stay in mumbai now recently shifted to gujrat umbergaon . Where should I should I give the complainant as I stay in mumbai . Plz guide me

Advocate Manisha Shelar answered
You can file a police complaint against him initially, in Mumbai. Provided that you have all proof, as in messages or phone call recordings to prove that the guy had promised to marry you, to build your case.

Q: My husband is not signing the divorce paper

My husband and I had a love story, and he manipulated me into marriage. I was 17 year old that time. After 10 month of marriage, I left the house and stayed separately because of his behavior . He promised to buy a apartment and I helped him with the money. But instead of him buying the apartment, he gambled it all away.he also abused me as well, daily coming in drunk. I started filing for divorce but he is not signing the paper. And daily he comes to my house and bangs on the door and threat me into giving him money and create so much drama. I asked police for help but all they say is they can’t do anything in family matter. What should I do now? I am scared for my life as well.

Advocate Manisha Shelar answered
As you said at the time of marriage you were 17, which means that you were minor at that time. You don't need a consent of your husband for divorce. You can file a suit for nullity of marriage directly on the ground that you were minor at that time and now you know that your husband is not the right choice for you. You will have to prove that your husband has made you marry him forcefully. You can file a contested divorce petition.

Q: cheques deposited by owner without intimation

office taken on rent from aug 20. 2mnths rent paid by cash @agreed amt of rs. 1.05 lacs p.m. no deposit paid as we had cash crunch. off hen taken was without electrical wiring etc. we spend nearly 7 lacs on wiring, acs. civil work, painting etc on verbal assurance from landlord two share cost towards wiring and painting, which was lateran refused by him. 2 cheques without date were issued in nov20. @rs.2.10 for oct and nov rent, rs3 lacs for mutually agreeable deposit. owner refused to make rental agreement and subsequently without any intimation deposited both cheques which were dishonoured due to insufficient funds. the ofc keys were given to him on jan 15,21 as per his demand. he didn't let us remove our ofc stuff. on feb 5, both cheques were redeposited again without any intimation and were agn dishonoured due to insufficient funds. there is no written agreement whatsoever except the initial 2 months receipt given by him. he is now threatening us. kindly advice

Advocate Manisha Shelar answered
Hello! Is he threatening that he will sue you under section 138? Because that is the only remedy he has now. And then you will have to defend yourself. The only way out is you both can settle the matter. Also to give an advice on these matter the lawyer also needs to see what all documents were made, Also the mails or messages that were sent, you should consult a lawyer personally.
