Q: Need to Withdraw the FIR. Please read full case of mine before ans pls

I have filed the FIR against my wife in 2022 under section 321, 506 and 504 of IPC. Now want to withdraw this FIR. There are many lawyer says to me that you need to file the quash application in Allahabad HC. But I don't know why Lawyers are not saying for section 320 of code of criminal procedure ? Because here I want to withdraw the FIR. For quash application I think my wife will filed the application in AHC. Can anyone please help me to withdraw the FIR with the help of 320 code of criminal

all section are compoundable in the section of 320 crpc, you can for settlement any time before judgement pronounce, Laywers advice you for quash because some time lower court doesn't accept settlement so it's better way fill quash in high court.

Wife filed false 498A FIR just to take revenge of the Police complaint and to separate me from my family.

According to Section 482 of the Criminal Procedure Code, 1973, high courts can consider quashing an FIR against an accused if no charge sheet has been filed against him. FIR if it turns out to be false, baseless or prima facie case is not made out against the accused.However, the Supreme Court clarified that the criminal proceedings initiated against the accused cannot be stopped simply because the police have not filed a charge sheet against any of his allegations in this matter. The decision to quash an FIR is based on the merits of each individual case and the High Court must be satisfied that the allegations are indeed baseless or that the accused has been falsely accused .



Q: Charge will be frame while pending of 482 petition

In a criminal case under 34/409 IPC and 66 c,d Of IT act , accused on bail. Accused move discharge application but reject by CjM and it's revision also reject by session . Then accused move to high court lucknow bench under 482 petition to challenge the discharge order including its revision which is still pending only notice issued by high court to responded. The. Does CJM court frame the charge against the accused while the pending of 482 petition

if there are no stay from high court then cjm do work as per legal procedure, cjm can Frame charge if no stay order passed by high court, there are no provision for stop procedure due to discharge application pending with high court



Q: my 4 year old daughter custody

i married in 2019 after matriage i got to know my husband is blood cancer patient in 2023 my husband expired after that i came to my parents house with my 3 year old daughter now i re married living happily with my daughter but now my ex husband family wanted my daughter what should i do now ...i cant live without my daughter.....is there any law which helped me to figure out this situation....my father in law said he go to court and he will surely take the custody of my daughter...please help

after death your your husband you have to right for re married no one can stop you there is no low regarding this and your daughter is still minor ,as per law you are first one who can care your minor daughter, if they bothering you can go to the court and take legal action them.
