Questions Answered by Advocate Krishna Jeevan Gaur

Q: Father is living separate from last 30 years and troubling us in prop

My father is living separate from my mother and we 4 siblings 2 brothers and 2 sisters. We are living in our ancestral house with mom but my father has disowned us from our house by signing an affidavit in favor of my aunt who also resides in the same house in which we are residing .she is claiming our portion which is in our possession as her's .she's a politician and having an affair with my father. What can we do to save our house portion

Advocate Krishna Jeevan Gaur answered
Under Hindu law, children acquire a right to ancestral property by birth; therefore, your father cannot unilaterally transfer your share to your paternal aunt or relinquish it at his own discretion. Since you currently have possession of the house, you should immediately take the following legal steps:1. File a civil suit for partition and a permanent injunction in the appropriate civil court to secure your rightful share and prevent the transfer of rights to a third party or your forcible eviction.2. Obtain an order for an interim injunction (such as a 'Status Quo' order or a temporary injunction under Order 39, Rules 1 and 2 of the CPC) to immediately protect your possession.3. Your mother can also file a case under the 'Protection of Women from Domestic Violence Act' (DV Act) to secure her right to reside in the shared household.

On the next hearing date, you can file a formal application under Section 309 Cr.P.C. to highlight the long delay and ask the court to direct a speedy disposal of the Section 319 application. The judge is empowered to penalize unnecessary adjournments and deny extra time, as a speedy trial is an essential part of personal liberty under Article 21 of the Constitution.

Q: How exactly does one change their name in India?

To legally change my name, where do I start? My question is not about general process, rather, I want to understand exact step by step process. Where can I get the affidavit notarized? And will it be enough if I publish the name change advertisement in local english and hindi newspaper? Is there anything I am missing?

Advocate Krishna Jeevan Gaur answered
An affidavit and newspaper ads alone do not give you a legally recognized all-India name change. To make it official across government databases (like PAN, Passport, and bank accounts), it must be published in the Official Gazette. For universal and central validity (recommended for passports, central IDs, and hassle-free acceptance), you apply to the Central Gazette (The Gazette of India) managed by the Department of Publication, Civil Lines, New Delhi. (Alternatively, state-level publication can be done through the Directorate of Printing and Stationery in Lucknow).
