आपकी स्थिति में यदि आप पारस्परिक सहमति (Mutual Consent) से अलग हो रही हैं, तो Hindu Marriage Act की धारा 13B के तहत संयुक्त रूप से Family Court में याचिका दाखिल करनी होगी। यदि सहमति नहीं बन रही तो Contested Divorce का विकल्प रहेगा।आवश्यक दस्तावेज़: विवाह प्रमाण पत्र, दोनों पक्षों के पहचान प्रमाण, विवाह की फोटोज़, यदि कोई सेटलमेंट डीड बनी हो तो वह, और यदि संपत्ति में हिस्सा नहीं चाहिए तो उसका स्पष्ट उल्लेख Settlement Agreement/Affidavit में करना उचित रहेगा ताकि भविष्य में कोई विवाद न हो।प्रक्रिया: पहली मोशन के बाद 6 माह की कूलिंग पीरियड (माफ़ भी हो सकती है), फिर दूसरी मोशन पर डिक्री पास होती है।
