The husband has 50% right in the flat so he has to be paid for the consideration amount in this scenario while the wife wants to rent out so ideally an agreement can be executed wherein the wife will have to pay the rightful consideration to the husband and thereafter the husband has to release his right in the flat so the wife can become 100% owner in the flat.

if the window installed by you is the common area of the society and not your own then you are in the wrong and encroachment of the society premises. the only thing you can do is to request the society to let you use it by paying some monthly premium to the society or remove the same.

Q: Legality for Leave and Licence Agreement

Dear Sir,1)I have a gifted residential flat in my name in a CHSL which was gifted to me by my late Father through a Registered Gift Deed.The CHSL's Share certificates in my name.2) Before more than One year ago, I received a Legal notice jointly from my sisters, husband of my deceased sister, wives of deceased brothers mentioning that Gift Deed made is fraudulent, illegal so,I cannot give for leave and license.3) IS IT LEGAL FOR ME TO GIVE ABOVE MENTIONED FLAT ON LEAVE & LICENCE ? if the gift deed is duly registered in the office of sub-registrar of assurances by your late father then you are the true and legal owner of the flat and can do with the flat as you feel like including giving it on leave and license agreement.

Q: Builder gave open parking exactly oppo to my parking

Hi,Please advise if taking legal action will help in this case. We have a covered parking space, and the builder allotted an open parking exactly opposite ours. When the other owner parks within the marked lines, it becomes very difficult for me to park my SUV.I have raised this issue with the builder many times, but he is ignoring it and only says he will ask the owner not to park on the exact line. I already damaged my car once while parking and had to replace the door.Please suggest.

Open parking can be allotted by the society as wel as can be utilized by many, if not allotted appropriately. In such cases, the best approach is to settle the dispute rather than running behind any individuals. Try to negotiate with the person parking it as well for thr convenience of both the parties and involving the society.
