Q: Challenging the property possession after 15 years

I have purchased an open plot 15 years ago . The plot owner was dead at the time of the sale and his son had registered the plot as he had presented the power of attorney at the time of sale. Now after 15 years his elder brother contacted us saying it was a joint property belonging to his father and he was not aware of the sale. Please suggest a course of action

Advocate Dornadula Penchala Praneeth Reddy answered
First and foremost check the ec of the plot. In that register time in the document info is important. If they are in valid means then The doctrine of adverse possession and limitation, more than 12 years they can’t claim the property. If the property is joint nature than also if his father gave any consideration for sale of agreement then section 27 of limitation applies for that property. Before the property in whose hand the property is very important. Consult a lawyer you have more than 80% chances to win the case.

Q: family property issue : my younger uncle and pedamma took our property

my mother bought property with her job savings on my grandmothers name before her marriage. my grandmother was blackmailed by peddamma my mothers elder sister that she will go to court if she will not register property on my younger uncle name. my younger uncle did not take care of my grand parents they are not in talking terms if my grandmother andmother file court case to get back our prperty . can we get back our property my uncle took property in 2008 his son is engineer in australia

Advocate Dornadula Penchala Praneeth Reddy answered
Mainly three things1. If the property purchased in the name of your grandmother and it is registered or not it is her self acquired property. If the property came from sridhan than your grandmother has sole right in that property2. If the property purchased through family funds then the property share will arise3. If it registered below December 20th 2014 no body can claim any right in that property. But registration is compulsory

Q: My father has two sons and a daughter. He has written a Will in my mother's name before his death. \

My father has two sons and a daughter. He has written a Will in my mother\'s name before his death. \nAfter the death of my father in 2020 my mother has written a gift deed to my brother secretly without informing me or my relatives.\nWhile I am trying for my father\'s death certificate the two documents came into light :\n1. Father written will in my mother\'s name \n2. Mother\'s Gift deed to my brother. \nThe property is my father\'s self earned property but my mother gave it to my brother secretly.

Advocate Dornadula Penchala Praneeth Reddy answered
Among the heirs are children, spouses, grandparents, siblings, and parents. It is possible for heirs to contest a Will if they do not get a proportionate share or are omitted from inheritance. As the major beneficiaries, they can legally challenge the Will. file a suit for partition.
