A case was registered against the opposing party on July 31, 2026, under sections 115(2), 323, 504, 76, and 109(1) of the BNS; two individuals were arrested in this matter and subsequently released on bail. That same party then filed a case under Section 56/3 in the CJM court, prompting us to file a case under Section 340 against them, regarding which the police had submitted an investigation report. Section 319 CrPC / Ab 358 BNSS**Yeh kya hai?*Yeh court ko power deta hai ki trial ke dauraan agar kisi aise vyakti ke khilaaf saboot aaye jiska naam FIR ya chargesheet mein nahi hai, to court usko bhi naya aaropi bana kar bula sakta hai.*Kab lagta hai?*1. Jab gawahi chal rahi ho aur gawah kisi naye vyakti ka naam le.2. Sirf police ke bayan se nahi, court mein diye gaye bayan se.*Kaun laga sakta hai?*Victim paksha application de sakta hai, ya Judge khud apni power se bula sakta hai.*Supreme Court ka rule - Hardeep Singh vs Punjab 2014*Court ne kaha - Yeh power bahut strong hai, isliye halke mein use mat karo. Tabhi bulao jab uske khilaaf pakka saboot ho jo saja dila sake.*Kya hota hai bulane ke baad?*Naye vyakti ko summon / warrant jata hai, us par naya charge lagta hai, aur trial phir se shuru hota hai.*Naya Kanoon:* Ab CrPC khatam ho gaya hai, BNSS aa gaya hai. Ab yahi Section *358 BNSS* hai.

My son promod kumar yadav wants to marry a Christian girl from Manipur state who was his college friend. Can they register their marriage in the court of tehsil registrar or sub registrar. Please advise for the required documents and procedures to be followed.

Advocate Dilshad answered
Yes, your son Promod Kumar Yadav and his Christian friend from Manipur can legally marry. This is an Inter-religion marriage, so it will be registered under the Special Marriage Act, 1954 before the Marriage Officer (ADM / Sub-Registrar), not Tehsil Registrar.Procedure: Both must apply with 30-days notice in the district where either has lived for 30 days. After notice publication and no objection, marriage is solemnized in presence of 3 witnesses.Documents Required: 1. Age proof (10th Certificate/Aadhar) - Boy 21+, Girl 18+, 2. Address proof, 3. 8 Passport photos each, 4. Affidavit of unmarried status, 5. 3 Witnesses with ID proof, 6. Divorce decree/death certificate if previously married.
