Q: Settlement of my father’s property after his death

My mother and my brother never took a NOC from me and my other two sisters and they sold my father’s house after his death and bought another house in 50-50 sharing and now sold that house too. Can we now claim our share?

Advocate Deepender Hooda answered
Yes, if there is no Will from your father. You need to prove the value at which the property was sold. Also in case they purchase some other property, you may claim share in that, provided you are able to show that subsequent property was purchased out of funds of your father’s property.

Q: Can Seller void notarized sale aggrement

My Father and me has taken token money of 10 percent to total value of property from buyer. My father is under medication from last 7 years. Even he is not able to do his daily task. After taking token money he was mentally upset and decided to revoke. At the time when we are signing the agreement the broker and buyer has forced us in many ways. The agreement notarized have clause of double money or property transfer from court. What harm buyer can do to us or he can take property or money

Advocate Deepender Hooda answered
The buyer may file suit for specific performance for double the money or transfer of property from court. Your remedy largely depends if the last date to complete the transaction is still there or not. For details you need to discuss with documents

Q: Property transfer- Civil Death Case

A person Mr. Satbir got declared civil dead by the court in the year 2018. His property got transferred ( in the year 2018) to his sons ( Narender and Virender) and his spouse- Rajrani. We purchased the property from these three in 2022. Now we have mutation and sale deed in our name. Now Mr. Satbir appears and claiming that he is alive and his family members fraudulently declared him dead and got the property. What is the probability/outcomes/rules that court will allow us to keep the land.

Advocate Deepender Hooda answered
By what document was the property transferred in the name of sons n wife. Has Satbir also challenged the court order of year 2018. Has he also impleaded his sons n wife in the suit. You are a bonafide purchaser that too after court order n purchased property from duly transferred titles and likely to succeed

Q: Agreement date expire 2 month pehle, but party not received.

Hamne ek property sale kari, 11 month ka pakka agreement banwaya tha. Party nai koi response nahi kara agreement expire ho gaya 2 month pehle.Ab party kah rahi hai ki, registry karwa do, property ki kimat 25 % increase ho gayi.Hamne 25 % extra maga to party nai kaha same agreement price par registry hogi.Ab wo hame court case ki damki de raha hai, jabki agreement 11 month ka tha, wo bhi 2 month pehle khatam ho gaya.Ab hum kya kar sakte hai.

Advocate Deepender Hooda answered
Do you have any idea if the purchaser got his attendance recorded before office of Sub-Registrar on last day of agreement. Else, you send purchaser a notice telling that agreement has become infructuous by reflux of time, the earnest money stands forfeited, he is left with no consequential rights under the agreement and you are free to sell the property to any third party
