Questions Answered by Advocate Deepak Sangwaan
Q: Pending litigation in P&H High court since year 2000 and 26 years.
HSMITC was a state corporation closed in June 2002.It did not extend the 5th pay commission benefit to its employees from 01 01 1996.Writ filed by employees in 2000. The employees succeeded in single bench in 2012. Govt filed LPA. Matter pending since last 14 years. Petitioners now senior citizens aged 70-80, some died. I requested to CJ & RG of P&H court individually for priority listing and early disposal. Can I expect some action by CJ High Court where matter pending for more than 14 years.
Advocate Deepak Sangwaan answered
Considering that the LPA has remained pending for more than 14 years coupled with the advanced age of the petitioners and death of some of them during the pendency of proceedings and the fact that the matter arises from an earlier favourable judgment of the Single Bench, the petitioners have a strong ground for seeking expeditious hearing. The appropriate relief before the Supreme Court would be a request to the Hon'ble High Court for consideration of the LPA on priority, preferably at an early date rather than seeking a direction on the merits of the appeal.
Q: Regarding Regularization Policy 2014
I am posted as a Data Entry Operator in HVPNL through Hartron Workstation Gurugram in a Government Department. However, the department did not regularise my services according to the 2014 regularisation policy. The department states that they had filed a case in the High Court, the decision for which came in May 2026. In its decision, the Court wrote - Needless to say, if case of the petitioners is considered favourably, they would be entitled to the same relief as has been extended to the pe
Advocate Deepak Sangwaan answered
On the facts stated, the first step should be to obtain and examine the complete judgment passed by the Hon’ble High Court in May 2026, particularly the exact relief granted to the similarly situated petitioners and the meaning of the observation that if the petitioners case is considered favourably they would be entitled to the same relief extended to the concerned employees. Since the 2014 Haryana Regularisation Policy was applicable to Group C/D contractual employees and was circulated to Corporations the employee should submit a detailed representation to the competent authority claiming consideration under the policy demonstrating that he satisfies all eligibility conditions and is similarly situated to the beneficiaries of the Court’s order. If the representation is rejected or not decided within a reasonable period an appropriate writ petition under Article 226 may be considered before the Punjab & Haryana High Court seeking quashing of the adverse decision and a direction for regularisation in accordance with the applicable policy and the May 2026 judgment.
Q: Won and got RC from UPRERA in September 2023... money not received
I have talked to DM, Tehsildar, Amin... written 12 letters to PMO... always getting unsatisfactory and confusing responses. Last response is that the case is in NCLT.... I want to understand my course of action to get my money... I am a cancer patient
Advocate Deepak Sangwaan answered
Since the matter is pending before NCLT, further representations to administrative authorities are unlikely to provide an effective remedy. The course should be to tell the exact NCLT proceedings. The client claim should be lodged before the concerned Liquidator with complete documentary proof and thereafter its admission should be monitored. If the claim has already been submitted but is rejected, an appropriate application before NCLT challenging such rejection should be examined. Considering the client cancer treatment urgent time-bound legal action rather than further administrative representations is advisable. Accordingly, the next step should be NCLT-focused rather than continuing only with administrative representations.
