Q: What can i do if someone makes false allegations against me ?

Sir, A person falsely filed a criminal case against me. The witnesses he made said they have not known the incident. But the Police have falsely written a chargesheet against me. If the case becomes false, what should I do against the Complainant and Police as they have falsely harassed me? what is the law against false allegations in India and punishment for false accusations in India? what can i do if someone makes false allegations against me ?

First contact you a criminal advocate in your local area and discuss with him details of the false case ,there after file a complaint u/s 182 ipc or claim for compensation u/s250crpc against the complainant .And you can fail a complaint u/s167ipc against the police who has lodged false FIR and harass you.

Q: Daughter Share in pension of father after his death

My Dad was a central government employee,expired 4 years back and My mom is no more. We are 4 sibiilings (2 brothers and two sisters). We have recently got to know that we shall be receiving das's pension with arrears as per the new rule of Central goverentment pension scheme. Can my brother claim for the pension amount without sisters signature ? How can we as a daughter claim for our share in his pension.

You have not clearly mentioned all brother and sister are major or minor and if any disabled child of your father.If any your brother name have been included in the PPO who will be claim without consent of any body .If name have not mentioned In PPO and all are major then signature of all are necessary in form no 14.

Q: How to protect or restrain a woman from disturbing the marital life

I am a Hindu by birth. My sister in law (nanad) has been very interfering in my marriage. She calls my husband constantly from 5 am in the morning till late in the night. This disturbs my marital life. My husband's behaviour changes every time he speaks to her. He gets violent abusive. Stops speaking for days. I filed for a divorce under cruelty. During the ongoing counselling sessions, he has been trying to reunite. But I get scared that the same erratic behaviour will continue. His sister is manipulative. Threatens to commit suicide now and then. What laws are available that can protect me or restrain that woman from disturbing my marital life? I want a compromise suit to be signed by him before I start living with him again. Please address.

No law is silent in the above situation. First you discuss with your husband and convince him to for beter marital life & avoid to hurt from in-laws behavior and try to leave separate house from her, then if not solve the problem then you will be file a report against the nanada 498A ipc before local police station.

Q: Procedure to obtain maintenance from husband

I am 35yr old married women.I am married since 7yrs to a gazetted officer.It was arranged marriage.I have 5yr old child.I got govt job in 2015 and since then I stay where I got posted.My husband stay where he do service.Now problem is my husband doesn't give a single money to me from his earning.Where ever I ask for He excuses by saying "u also earn why should I give".I ask for child fees,my medicine,my food then also He never gives. so I want justice by asking my portion of alimony and my child. Pls give me suggestions what is right for me.

First you request to your husband and convince him that you have not sufficient earn to maintain self along with child or you can take help of family counseling ,if not solve the problem then you will file a maintenance case before your local family court. Father is bound to maintain his child and his wife if she unable to mainten herself.
