Q: Income certificates for EWS or OBC

I prepared IIT-JEE entrance exam and want to take admission in college. I have confusion in the family income which will require and mandatory to be filled in the admissions form. My father passed in 02 yr ago and elder brother, age 18+ has business shop income around 03 lakh. My uncle, age 32 has govt Job group B, living separately. I belong to OBC Non cremy layer. Can I apply for less than 1 lakh family income as my individual income is zero.

As per Government of India norms, the term “family income” includes the income of parents (if alive) and dependent members of the family residing jointly. Since your father is deceased and your uncle is living separately, his income will not be included in your family income. Only the income of your mother (if any) and dependent brother’s income from business (₹3 lakh approx.) will be counted. Therefore, your family income will be considered around ₹3 lakh per annum. You cannot show your individual income as zero for OBC non-creamy layer certificate or college admission purpose, as it is the family income which is relevant, not individual income.

Q: Regarding arrest for alcohol consumption

I was caught for drinking alcohol. And I was in locup for whole night in excise office. And next day they took me to court and I appeared before judge and I paid fine and I was released. Will it cause problem in police verification for government job?

आपका मामला एक लघु उत्पाद (Excise) संबंधी उल्लंघन प्रतीत होता है — अर्थात शराब पीने या रखने के कारण आपको पकड़कर अदालत में पेश किया गया, जहाँ आपने जुर्माना भरकर मामला निपटा दिया। यह अपराध गंभीर या नैतिक अधमता (Moral Turpitude) से संबंधित नहीं माना जाता, बल्कि एक compoundable petty offence (साधारण जुर्म) की श्रेणी में आता है।इस प्रकार के मामलों में, यदि आपको केवल जुर्माने की सजा हुई है और कोई आपराधिक अभियोग या कारावास नहीं हुआ, तो सरकारी नौकरी में पुलिस वेरिफिकेशन के समय आमतौर पर कोई गंभीर समस्या नहीं होती।फिर भी निम्न बातों का ध्यान रखें:1. अदालत द्वारा दिया गया जुर्माने की रसीद या आदेश की प्रमाणित प्रति अपने पास रखें।2. यदि वेरिफिकेशन फॉर्म में पूछा जाए कि “क्या आपके खिलाफ कभी कोई मामला दर्ज हुआ था या किसी अदालत में पेश होना पड़ा था,” तो इस घटना का ईमानदारी से उल्लेख करें।3. यदि आप इसे छिपाते हैं और बाद में रिकॉर्ड से पता चलता है, तो इसे जानकारी छिपाने (suppression of fact) माना जा सकता है, जिससे भविष्य में समस्या आ सकती है।निष्कर्ष:सुप्रीम कोर्ट के निर्णय (Avtar Singh vs Union of India, 2016 (8) SCC 471) के अनुसार, इस प्रकार का एक मामूली मामला, जिसमें केवल जुर्माना हुआ है और कोई आपराधिक इरादा नहीं था, सरकारी सेवा के लिए बाधक नहीं होता।लेकिन सच्चाई छिपाने की बजाय सही जानकारी देना सबसे सुरक्षित और कानूनी रूप से उचित रहेगा।

Q: फाइनल सिलेक्शन में कैंडिडेचर रद्द कर दिया गया हैं

सर सिविल कोर्ट क्लर्क रोजगार संख्या 01/2022 के तहत बिहार सिविल कोर्ट की भर्ती आई थी जिसमें अपने पूर्व के employer से NOC या PERMISSION लेकर फॉर्म भरना था।परन्तु में फॉर्म भरने के समय leave में था। ओर फॉर्म भरने से पूर्व NoC नहीं ले पाया और बिना noc लिए फॉर्म fill किया परन्तु leave से आते ही noc के लिए अप्लाई किया और मुझे noc/permission department से मिल गई। जो में डॉक्यूमेंटेशन के समय कोर्ट क्लर्क document verification board ko जमा कर दिया।उसके बाद भीफाइनल रिजल्ट में मेरा candidature रद्द कर दि

अधिसूचना की कॉपी सुरक्षित रखें जिसमें “prior permission/NOC” का प्रावधान लिखा हुआ है।यह देखें कि रद्द करने का निर्णय कब, किस आधार पर और क्या कारण लिखकर दिया गया है — क्या आपको कारण बताओ (show cause) नोटिस मिला था?एडवाइज़री या WRIT पेटिशन विचार कर सकते हैं — यदि आपको विश्वास है कि रद्दि अवैध है, तो आप Patna High Court में न्याय प्रार्थना कर सकते हैं।भविष्य के आवेदन के लिए: आवेदन के समय नियोक्ता से NOC/permission लेना सुनिश्चित करें तथा आवेदन में स्पष्ट रूप से जानकारी देना सुनिश्चित करें।
