Should 1st Class Exec Magistrate Affidavit bear the Magistrate's Name? For a name change request in Voter ID, I was asked by concerned election commission officer to obtain 1st class executive magistrate affidavit certifying the same. An advocate [public notary] agreed to do entire job in exchange of his service charge. The affidavit handed over to me contains only a signature and a rubber stamp with text "Executive Magistrate, Mumbai City",without mentioning name of the Magistrate. Pls Guide.

Merely having a signature and a generic rubber stamp stating “Executive Magistrate, Mumbai City” without mentioning the name of the concerned Magistrate makes the document doubtful and may not be accepted by government authorities.Further, an affidavit attested by a Public Notary is not the same as one sworn before an Executive Magistrate. If the Election Commission office has specifically required an affidavit from a 1st Class Executive Magistrate for the purpose of name change in the Voter ID, it must be executed in the presence of such Magistrate.Therefore, it is advisable to obtain a fresh affidavit duly sworn before the competent Executive Magistrate, ensuring that the document contains the Magistrate’s full name, designation, signature, date, and official seal to avoid rejection during the Voter ID name-change process.
