You can file for divorce on the ground of cruelty under Section 13 of Hindu Marriage Act. Mental abuse of any kind is considered as cruelty for divorce. Liability of house will be shared equally as mandated in Agreement.

Q: Regarding alimony in HMA sec 13 filed by wife

Dear sir/madam, my wife filed a HMA section 13 case for divorce in 2022. Now case in judgement stage. My wife did not file case under sec 24 or crpc 125. I have 4 questions1. is there any provision of alimony/maintenance under HMA 13.2. How can my wife claim alimony3. For claiming alimony, does she have to file another suit.4. Does she have to prove my income in court to claim alimony. 5. She filed case under DV 12 For maintenance, can she get both alimony and maintenance at same time?

Answers corresponding to your questions are:1. At the time of passing of decree of divorce alimony will be provided automatically as per Section 25, HM Act.2. As per Section 25, HM Act.3. No.4. You will have to file details regarding your Income / Assets / Liabilities on affidavit in the court.5. Maintenance under DV 12 Act will be adjusted against alimony.

Aap Restitution of Conjugal Rights ki Decree ke 1 saal baad Divorce ke liye is ground par apply kar sakte ho ki RCR ki Decree ke baad bhi aapki biwi saath mein rehne ko raaji nahi hai. Yeh Case Section 13(1-A)(ii) HM Act mein file hoga.

Q. After Enforcement of BNS,2023 (Bharatiya Nyaya Sanhita) which replaced the Indian Penal Code, 1860 whether the State of Uttar Pradesh Amendment Act in criminal laws which was applicable to IPC ,1860 is also applicable to BNS ,2023 or not?

No. Only the Sate Amendments of Uttar Pradesh since enforcement of Bhartiya Nyay Sanhita, 2023 will be applicable to Bhartiya Nyay Sanhita, 2023. Indian Penal Code has been completely replaced by Bhartiya Nyay Sanhita, 2023 subjected to pending proceedings, etc.

मेरा सवाल यह है कि मेरे पास डायरेक्ट कोर्ट का NBW आया. जानकारी करने पर पता चला कि आपको NBW डायरेक्ट इसलिए आया है कि जो नॉर्मल वारंट या BW होता है उसमें पेशकार को पैसे खिलाकर दबा दिया गया और आपके खिलाफ डायरेक्ट NBW इशू कर दिया गया है. जबकि NBW से पहले मेरे पास कोर्ट का कोई भी नोटिस या BW नहीं आया.जब वकील साहब से पूछा क्या मैं इसमें कोई शिकायत कर सकता हूं तो उन्होंने बोला आप कुछ नहीं कर सकते. क्या आप बता सकते हैं इस बारे में मैं कोई शिकायत कर सकता हूं या नहीं.धन्यवाद

आप पेशकार की शिकायत पेशकार के नियुक्ति प्राधिकारी से कर सकते हैं। आप जब अगली तारीख पर वारंट को रिकॉल करने का प्रार्थना पत्र देंगे, तब जज साहब से भी इस बारे में कह सकते हैं। आपका वारंट रिकॉल हो जाएगा और आप को पुलिस गिरफ्तार नहीं करेगी।
