Q: Domestic violence. Physical, mental, emotional and verbal abuse

I'm 24f & my sis 22f. My dad was abusive since our childhood. There were years where I got beaten up daily. He gave me nick names like idiot, fool, etc., He threatens to kill us whenever we don't behave right from when we were kids. Now after we grew up the abuse got more verbal and mental. He slut shames us when angry. He slut shamed my sister for wearing a perfume! He used to confiscate our phones at night because I talked to my depressed friend at night. He spies on us every night. He now forces us to wake up at 6 am though there is no work to do. Last Sunday we slept till 9 am. He verbally abused and threatened to beat us up if we do it again. We should keep our rooms open till night. We're not allowed to step out of the house for anything or than visiting temple with family. We're not allowed to go out, to meet friends, shopping, etc. We're in a house arrest situation. We are suicidal now. Shall we press charges against him?

You are at liberty to approach your jurisdictional police station and lodge a complaint against your father. In addition you may also move to the Social Welfare Officer available at District Collector Office and lodge a complaint regarding Domestic Violence and thereafter the same could be referred to the Magistrate Court for enquiry.



Q: AB Bail for 498A , 3,4 of DP Act

My wife has registered false 498A and Dowry case against me and my family in her native place Nellore -Sullurupeta(AP) police station. I had contacted lawyer and paid fees for AB Bail. Now after two weeks he is telling that court advised get bail from police station since punishment under 498a is 3 years only and he told told he will arrange suriety for bail but we have to pay some amount to police as bribe.. I am confused now, whether what lawyer told Is correct. Is it okay to get station bail or Should I insist lawyer to go for AB Bail.

498A is bailable only in AP. As such you may get station bail itself. But you may also charged with some other sections which relates to curelty. So first analyse that and move to the station for bail.



Q: How to take legal heir certificate for my father who died in 1990 ?

My grand father has a land in his name.The patta for that particular land is in my father's name. Now both of them are died. I want to sell that land and my brothers and sisters also agreed to sell but registrar asks for legal heir certificate for my father . He died in 1990 and he has no brother or sister . My father is a single child for my grand father. Now how to take legal heir certificate for my father ?(religion is hindu)

You may apply for legal heir certificate through online eservice source. You have to produce the death certificate and other relevant certificates during that course. After due enquiry you may get the legal heir certificate. in case of refusal you may approach a civil court by filing a civil suit for declaring you and your siblings as legal heirs of your deceased father and get a decree and produce the same before registrar.



Q: Ancestral property total family given registered G.P.A

Ancestral property total family given GPA (registered) to 2 of themselves, GPA holders 1 and 2 entered a registered sale agreement with me of d property I paid in DD both of them the entire 1cr 5 lakhs money and 4 lakh balance,then they started denied to come to register I have filed a specific performance case against them.i have shown in my income-tax also they r telling in reply notice that money taken for loan only not for sale of the property, the same g.p.a holders 1 and 2 sold 1 acre in the same survey no 5 months back on my sale agreement Date.

In addition you may also implead the subsequent purchasers to the case which you've filed and sought for declaring the subsequent sale deeds as null and void.



Q: Someone owe's me 1 Crore rupees, how can I recover

Hello Sir,I lent someone Rs 45L in 2017 and with an interest of 3%, it comes around Rs 1Cr as of Nov-2021. Now he is trying to cheat by reducing the agreed interest amount and also he is not solidly saying he will pay back the money.Documents: 1. I have pro-note on Rs 100 stamp paper saying that he and his wife agree to borrow Rs 20L and Rs30L separately and will pay Rs 3 for each Rs 100(3%) until the money is returned2. I have 2 blank cheques he provided in 2017 one on his account and one on his wife's account signed by him and his wife respectively.What are my options here if I need to take this legally, should I submit the cheques to the bank and let it bounce and file section 138 against them? will the cheque stand legally since it was given in 2017 (but no dates on the cheque just their signature)any advice would be appreciated, thank you
