Q: अपराधियों के विरुद्ध धारा 354 लगने के पश्चात उसको दोबारा हटाने प्रयास
हमारा किसी व्यक्ति से लड़ाई झगड़ा हो गया था जिसमें अपराधी पक्ष ने षड्यंत्र पूर्वक विवाद करके हम पर हमला कर दिया जिसमें धारदार हथियार का प्रयोग भी किया गया था एवं बीज बचाओ में आई महिला के साथ मारपीट अभद्र गालियां जान से मारने की धमकी और कपड़े फाड़ दिए गए इस पर कोर्ट में धारा 354 के तहत बयान हुए एवं केस दर्ज हो गया जांच अधिकारी ने धारा 354 प्रमाणित पाई एवं उच्च अधिकारी द्वारा धारा 354 में चालान पेश करने का ऑर्डर कर दिया गया परंतु अपराधियों ने उच्च स्तर पर अधिकारियों से मिलीभगत करके 6 माह तक चालान पेश नहीं होने दिया एवं द्वारा सत्यापन के नाम पर जांच करके धारा 354 हटा दी गई क्या इस प्रकार कोर्ट द्वारा बयान लेने के पश्चात तथा एक बार धारा 354 प्रमाणित होने के पश्चात तथा चालान पेश करने के ऑर्डर होने के बाद भी धारा 354 हटाई जा सकती है हम फरियादी हैं तथा इस प्रकार हमें बहुत ज्यादा मानसिक प्रताड़ना झेलनी पड़ रही है

श्रीमान आपको सबसे पहले यह बता दु की आपके बयान 161 में दर्ज किए गए थे अगर आपके 164 के बयान किये होते तो आपको मजिस्ट्रेट के पास बयान के लिए पेश किया जाता और साथ ही मजिस्ट्रेट आपके बयान को धारा 164 के तहत दर्ज भी करता । अगर जांच अधिकारी ने उक्त धारा 354 हटा दी है तो आप न्यायालय में इसे जुड़वा सकते हो अगर न्यायालय को उचित लगेगा तो आपके प्रार्थना पत्र पर धारा जोड़ दी जाएगी ।

नही इससे कोई प्रभाव नही पड़ेगा क्योंकि जब तक संबंधित कोर्ट में आपके खिलाफ चार्जशीट पेश नही हो जाती तो उसके बाद आपके खिलाफ आरोप पत्र पेश होने के बाद आपका नाम किसी मुकदमे में दिखायेगा ।इसलिए आप घबराये नही ।। बल्कि लोक अदालत में इसका निस्तारण करवा लें
