POSH Compliance deadline for Noida based companies extended till 15th February 2020

The District Magistrate, Gautam Buddha Nagar has released a notice extending the deadline for submitting the annual report under Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013 till 15th February 2020. The extension has been made for submission of the annual report for the year 2019 for all the private and government organizations operating in Noida with 10 or more employees.

While extending the deadline, the notice has also exempted the organizations with less than 10 employees from the formation of ICC and has made it mandatory for them to notify the same in writing to [email protected]. Moreover, it has stated that organizations having no female employees at the moment can form an ICC with male employees as acting chairperson of the ICC till such time as a lady employee can be appointed as the chairperson of ICC.

Earlier, the DM had released a circular which had made it mandatory for all the private and government organizations operating in Noida to register the details of their Internal Complaints Committee on a mobile app by November 30, 2019 and uploading Annual ICC Report for 2019 by January 31, 2020.

In this regard, the district administration had launched SHOR (Sexual Harassment Online Redressal) mobile app on 18th October 2019 to monitor sexual harassment cases at the workplace in the Gautam Buddha Nagar District. The app has been launched with the aim to provide a transparent probe and speedy redressal of sexual harassment cases and is available for free download on the Google Play Store.

It is mandatory to form an Internal Complaints Committee and to submit the required details and annual report under the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013. Failure to comply with the same can also attract penalties as prescribed under the Act.
