If you have any traffic challans pending and require them to be waived off or settled, then this Article is for you. Pending Challans can be waived off at Lok Adalats that are held 4 times a year. Read on to understand the process involved in Token Registration and Waiver of Challans for National Lok Adalat 2023.
NALSA (National Legal Services Authority) has officially announced the National Lok Adalat 2023 Schedule to be taken up on 9th September 2023.
However, in Delhi, the date for the Lok Adalat is 8th October 2023 (a delayed date due to the G20 Summit).
The Lok Adalats shall take place across the nation and whoever has a pending motor vehicle challan such as driving without a driving license, a motor insurance, permit, fitness certificate etc. can get the challan amount settled for a much lesser amount at the Lok Adalat. It is a possibility to get the entire challan amount waived off as well.
Alternative Dispute Resolution Mechanisms, Lok Adalats are forums wherein the cases that are pending in courts or disputes in pre-litigation stages are compromised and settled amicably. Statutory status has been granted to the Lok adalats under the Legal Services Authorities Act, 1987. It states that an order/award passed by a Lok Adalat will have the status of a civil court decree and shall be final and binding on the parties involved. No appeal lies against such an award of the Lok Adalat before any Courts.
Under Section 19 of the Legal Services Authorities Act, 1987, Lok Adalats are organized by the Legal Services Committees/Authorities, under the guidance of NALSA.
In the year 2002, Chapter VI-A was inserted in the Legal Services Authorities Act, 1987, providing for compulsory pre-litigative mechanism for conciliation and settlement of disputes relating to ‘Public Utility Services’.
During Covis, E-Lok Adalats have also been conceptualized thereby improving significantly, the access to justice for people who were otherwise unable to participate in the Lok Adalats.
There are many traffic challans across various states for Commercial, Non Commercial and other types of vehicles which are unpaid hence NALSA conducts National Lok Adalat four times a year in which all the pending challans and other common cases are covered on the spot and justice is delivered.
The 3rd National Lok Adalat for the year is set to take place across the country on 9th September 2023, except for Delhi, for which the date is 8th October 2023.
The Lok Adalats are to be held at district courts of all state and union territories of India. There is a set procedure to get registered via Token Registration on the official websites of National and State Legal Authorities.
