Registration of a will at my home

Hello, My question is , can a will be registered at my home. My dad is old and not able to go to the registrar and so I want to know if someone can come to the house and register the will.. Thanks.

This is my response to you:
1. You will have to approach the office of the sub-registrar;
2. You will have to make an application to the office stating that, under special cases, the registering authority to attend your home;
3. Keep witnesses ready, one of them should be a medical practitioner;
4. Attach a medical certificate to the Will stating that the testator was medically fit while executing the Will;
5. Consult a local lawyer and take steps.

Under Maharashtra Registration Act, there is a provision wherein, the Sub-registrar comes to your home to register your document. To engage this service, you have to produce a medical evidence that you cannot be taken on wheel chair to Sub-registrar's office.

To assist registration of the documents, in the same office, two sub-registrars sit,

1. In the morning, from 7am to 2pm and another in the evening, from 2pm to 9pm, on all the days, except on second and fourth Saturdays, all Sundays and Maharashtra Government holidays.

2. These registrars, visit before or after their duty hours to person's residence. For example, a sub-registrar, who comes to his office at 7am, will visit your home, after his office duty is over, at 2pm. One sub-registrar who comes in evening duty, will visit your home, before his duty starts, at 2pm. That is between 12pm and 1pm one of the two Sub-registrar will come to your home to register your will, and he will deliver your registered will next day, same time, at your home.
For this service, you will be charged Rs.1,000/- (rupees one thousand only) as visit fees, for which you will get Government Receipt.

You will also be charged Rs.100/- (rupees one hundred only) as registration charges to register your will, and Rs.10/- (rupees ten only) as registration fees for each pager of your will.

For example, if your will is of eight pages, then you will pay Rs100+Rs.10x8=Rs80, grand total Rs.180/-, towards registration fees.

As a courtesy, you may pay some more money as out of pocket expenses to Sub-registrar and his accompanied staff, to meet taxi or auto charges for transport from and to his office.

Dying intestate (that is, without making your will) involves lot of complications in transferring your estate to your children or any one, it is better to make a will.

Only after the executor has taken the initiative to register the Will at home, can it be done. The will will only be registered after the registrar has completed his investigation into the validity and authenticity of the will.
