I maaried about 20 yrs back . But we have disputes from starting . We don't have any child. My wife has put false allegations in court against my family. Now i am in delhi and she is residing in u.p my village house. She and her father is in greed of my property. My father died 4 yrs back intestate. Property is divided into 3 parts(1 me + 1 brother + 1 mother). I made relinquishment deed in favour of my mother and she made will in favour of brother's son. Is property safe or she can claim over property?

Wife has a right of residence only in the property which belongs to husband. However if you have already relinquished your share to any other party, she would not be able to claim anything. However she can still challenge the same to show the malafide that so as to deprive her of any claim you have relinquished your share. Better can be discussed in detail. Feel free to contact

Thanks

The meaning of relinquishment deed is surrender one's ownership right to co-owner. So if you have properly registered the relinquishment deed. You will not be the owner anymore and the question of your wife to claim in your property also ends. But do verify your relinquishment deed to any advocate for any legal issue in the future.

In a Court case, what a wife seeks is Temporary or/and permanent alimony, which would be granted to her taking into account your/her financial status.

A will only comes into force just after the death of the testator, otherwise Will has no force, when a person is alive. She is free to make a will.
