Builder is delaying possession of flat and is not paying Pre-EMIs

30-Sep-2023 (In RERA Law)
Hi, I had bought a 1082 sq ft. property 1.5 years back in underdevelopment project Tower CB4 of Supertech Capetown. As agreed with the builder at the time of contract signing, all the pre-EMI payments were to be done by the builder till the time the offer of possesion was made to us but the builder has stopped all pre-EMI payments since June 2019 in violation to the MOU signed at the time of contract signing. We've been paying the pre-EMIs since then. The builder had also promised to pay a rental of Rs. 10,000 till the time of possession as per another MOU which had also stopped since Nov 2018. The initial delivery date of the project was communicated as Dec 2019 by the builder which has now been moved to Mar 2020 and as per my site visit assessments this will most probably be pushed further down. Would like to know what kind of legal action can I take against the builder under RERA or consumer protection law. Regards, Siddhartha Banerjee +918512002377
