Well, you can lodge a FIR against the Builder to do Cheating with you under Sec 420 of the IPC. You can also file a Case of Breach of Contract under the Indian Contract Act, 1872 for violating the Contract between him ( the Builder) and Tenant by not paying the Rent which was decided in the Contract signed between the Builder and you
