If they are not listening to you then you can send them a legal notice and in that notice you can write either remove the unnecessary comments/defamation or face legal action. And if want to go legal then you can always forward a written complaint to the police station of your area. For more legal assistance I am just a call away.

Hi,

Based on your query, it is quite clear that the app is a scam aimed at extorting money. In fact a preliminary search on the app shows:

1. The information of the owner of the app has been hidden on the google play store by said owners in a bid to remain anonymous

2. Its alleged primary NBFC lending company had no online information or evidence of registration with the RBI

It is suggested that you file a complaint with the cyber cell as well as one with the RBI regarding this issue. If you require any assistance in this matter please feel to contact me.

Hi

So, since you have provided your details, what they have done is punishable under law.

You send a legal notice first i.e. part if your recovery process ( civil nature) and then can take action by filing a police complaint under criminal law for fraud and breach of trust.

Thanks.

When dealing with harassment and defamation due to a fraudulent loan app and recovery agent, it's essential to take appropriate legal steps to protect yourself. Here's what you can do if you're facing such issues:
  1. Gather Evidence: Document all instances of harassment, including messages, calls, or any other form of communication from the loan app or recovery agent. This evidence will be crucial in pursuing legal action.
  2. Cease Communication: If you feel threatened or harassed, consider blocking the loan app or recovery agent's contact. Avoid engaging in further communication with them.
  3. Contact Cyber Cell: Report the harassment to your nearest cyber cell or cybercrime department. Provide them with all the evidence you've collected. They can guide you on the appropriate legal action to take.
  4. Legal Notice: Consult with a lawyer who specializes in cybercrimes and defamation. They can help you send a legal notice to the loan app and recovery agent, demanding that they cease their activities and issue an apology.
  5. File a Complaint: If the harassment continues despite legal notices, file a formal complaint with the police against the loan app and recovery agent. Share all the evidence you've collected.
  6. Seek Legal Remedies: Work with your lawyer to explore legal remedies such as filing a defamation lawsuit or seeking injunctive relief to stop the harassment.
  7. Consumer Forum: If the loan app engaged in fraudulent activities, you can also consider approaching a consumer forum to seek compensation for any financial losses you've incurred.
  8. Protect Personal Information: Be cautious about sharing personal information online. Ensure your privacy settings are secure on social media and other online platforms.
  9. Stay Informed: Stay informed about legal developments and your rights regarding harassment and defamation cases in your jurisdiction.
