Wrong assessment and payment made to a developer

Thru a friend who was very close to a land developer, got convinced to buy a plot. As per friend, since the developer was to increase the rates shortly and the developer was out of country, he advised to pay an interim advance which has been paid to deveoper's company account thru net banking. Now, one evaluation, found that the rates are too high and decided to drop the idea. No agreement paper made or no receipt recived but proof of transfer of money is there as this was thru net banking. Developer is now not committing to refund money.

see there's a clause sometimes in ma y agreements that in case you get the allotment cancelled, some percentage of the amount can be forfeited.
