Without rent aunt let her neighbor reside in our property
11-Jul-2023 (In Property Law)
** my late maternal grandfather has two children. my mother and my maternal uncle. after my grandfather's death my maternal uncle used to stay in my grandfather's house with his family ** Three years back they moved on to a new flat vacating the house ** around 7 months back they without my mother's permission allowed their neighbor reside in that house with their whole family ** when we raised objection my cousin brother ( my maternal uncle's son ) requested us to let them stay in that house and said that that neighbor will vacate the place anytime we will ask them to do so and if then they create any problems my cousin brother will take the liability arising therefrom. ** since it was a request I couldn't deny the proposal but I really don't feel it is safe to let anyone reside in someone else's property. Again there is no clarity as to how long they want their neighbor to reside in that house. it can be for 1 year, 5 years or 10 years ** the whole thing seems very wrong to me. Help
You did not mention about the status of the property. Is it ancestral or self-acquired property. On what basis did your mother inherited the said property. If it was a self-acquired property and there was a will which spell out making your mother the beneficiary then she is the bona fide owner of the property. If there was no will, then both your mother and maternal uncle are legally entitled to equally share the property. The law is very clear on this.
You did not mention what is your religion. Legal positions cannot be answered without complete facts, as the answer will differ from one facts to other facts.
Also find out whether your cousin brother (maternal uncle's son) had sold out a portion of this property to this so-called tenant. I smell something very suspicious behind this, as you're not sure about the status of this so-called tenant. Should you need any guidance you may contact me.
