Who will be the heir of self acquired property of mother

We are living in a house which is on the name of our late mother. This house was built by her by her own sources. We are three brothers and our father is still alive. Our father is trying to push us out of this house. We want to know that as our mother is not alive, to whom this house can be transferred as per law. If the right is to our father or to us? or all have equal rights? or only we brothers have right on it? Please clarify

You have not mentioned your religion in your question. However, assuming you to be a Hindu, I shall let you know the rule of succession in the case of female Hindu dying intestate. As per Section 15 (1) of The Hindu succession Act, you, all three brothers and your father are entitled to each share, means you all four are entitled to 1/4th share in the property.

As per the hindu succession act, property will be divided among all sons, daughters and husband of the deceased. If your father is pushing you can take legal action. Contact me for further discussion on the matter.

that in this matter it is most important question is that wether your mother died intestate or testate you did not clear your questions to this aspect if she has not got registered any will in favour of anyone then you along with your father are eligible person to get the mutation entered and sanctioned in your favour

After your mother, you all (you, you father and your brothers) will have equal right in the ptoperty left by her. Your father can not throw any of you out of the house as you are co-sharer in the property.
