Who all heirs for my brother property without will
26-Jun-2023 (In Property Law)
We are 7 brothers and I am the 5th one. My late mother has got a Will registered (in 2001) for her own cash and gold assets in her eldest son (1st) unmarried and youngest (7th) married sons names. In 2016, 1st son has died and we are not sure if he has written/ registered any will for the cash and gold that he has got in his name. Since he was unmarried, what happens to the assets (Cash and Gold) he has got from our mother? Can we (the other 5 bothers except Harinath {7th son}) claim that or if he has written any will for that, how do we get to know about that?
File an Probation & Succession Certificate suit before civil court at your place. Collect the information about your brother's bank account number, insurance policy, shares if any etc and death certificate of your brother and Will deed of your late mother it can be submitted at court and provide the evidence to the court that you are deceased 's brothers and legal heirs as he died unmarried and not having any dependents, hence you are his kin by relation and would like to claim his assets. Court will direct the concerned authority to present then public notice will be issued to know is there any body behalf of your brother to claim etc: If there is no objection from anybody then it may order in your favor.
