Whether government can demolish building property without intimation

During the process of road widening the govt contractor is demolishing my building/partial property without any proper intimation or notice or compensation. how can i proceed further? what re the rules for demolishing a house in india? our family had been living there since 30 years

No. The government without issuing notice cannot demolish the property of yours. The Government issue a notice and after paying the compensation through Cheque then only can demolish. If there is no notice you can approach an advocate and file a Writ Petition before the High Court after giving a representation to the Government and basing on the Government reply/ not giving any reply. Then you can get an appropriate justice in this regard.

Sir, it is heart burning and live issue of general importance of often the municipal authorities adopting attempt to demolish starting in the evening of Friday preventing persons approaching Court, as such, you have good legal right. The Government or municipal authorities or government contractor cannot demolish building/partial property without any proper notice or intimation or compensation. So, you are having legal right to protect from demolition by filing a civil suit or writ petition before Hon'ble High Court restraining the municipal authorities and government contractor from demolishing the building/partial property even in case of urgency, for out of order petition in civil court or lunch motion or house motion before Hon'ble High Court for urgent relief since you have been residing in the building since 30 years and Law provides right for protection.

You must immediately go to High court and get stay order. You must be given notice before demolition. If you are not satisfied with compensation you can also ask for raise in compensation. You can also approach local police station if a private contractor is demolishing.
