What is the difference between gift deed and partition deed

Hi, I would like to transfer 25% of his self earned property to my wife, 50% to my son and keeping the other 25% to myself. Apparently, doing this through Gift Deed does not retain the title of 25% ownership of my share. Please suggest which is better, Gift Deed or Partition Deed. Are there any drawbacks using Partition Deed and will the stamp duty charges (in Karnataka) be very similar to the Gift Stamp Duty charges

Transferring to wife and blood relatives like sons will involve same stamp duty in Karnataka. Doing whichever is your choice. No drawbacks as I see exists in any of these two. You need to pay for papers drafting also.

per the Income Tax Act, 1961 if the value of gifts received is more than Rs. 50,000 a year, then such amount is taxed as income in the hands of the receiver. These gifts may be in any form – cash, jewellery, movable and immovable property, shares etc.
However, this rule is not applicable if your relatives present the gifts. Now just to escape gift tax in India you can’t call a person your relative saying he is the son of my uncle’s neighbour’s vendor’s sister! To avoid scenarios like these, the income tax rules specify relatives from whom tax free gifts can be received. These are:
Parents
Spouse
Your and your spouse’s brothers and sisters
Brothers and sisters of your parents
Your lineal descendants (including spouses)
Lineal descendants (including spouses) of your spouse

A gift deed can be used to transfer ownership from one person to another without paying for it. A partition deed is more suitable if there are several parties involved. However, a gift deed would be better suited for transfers between family members.
