What are legal remedies against illegal construction

Builder has alloted private terrace to second floor. It is mentioned as private terrace in approved plan That terrace is not included in UDS or buit-up area. Now the second floor owner is going to start the construction in the private terrace which is exactly above our flat master bedroom. We would like to get the stay order on the construction. Please let me know the procedure to get the stay order on this illegal construction. How long it will take to get it? Can one make illegal construction legal?

Hi, you must file a suit for injunction restraining the builder, his men or agent or any other person, from putting up illegal construction. By contending the position before the court you can get a interim stay at the first hearing and can stall further work in the terrace.

Has the second floor owner obtained the permission from CMDA to make further construction in the second floor?? If not you can Make a complaint before the CMDA and also approach the court.

Dear Sir, We can stop the construction subject to review of approved plans, Road frontage earlier and now frotage etc. The property lies under which catogory for example CMDA. DTCP limits, Several information required to stop this.

You can straight away file a Writ petition before the high Court. Before that you need to make representation before the authorities highlighting the illegal construction is being put up by owner. If the concerned officer is not taking steps to stop the illegal construction and to demolish them you can seek the High Court indulgence for demolishing the illegal construction.
