Wanted to buy property made agreement seller not registering property

Dear Sir/Mam, We have entered into a pre sale agreement(Biana) on a Rs. 2000/- stamp paper.Ikrarnama(Biana) was just typed on Rs. 2000/- stamp paper and signed by both parties.Ikrarnama (Biana) is not notry attested or registered anywhere.Now seller is neither willing to do registry nor to pay earnest money. 1.Ikrarnama on Rs 2000/- stamp paper(Not notary attested or registered anywhere) is valid one? 2.Can I sue the seller based on only Ikrarnama(Biana)? Please guide me accordingly.
Agreement to sell/purchase is a valid agreement. It doesn't require any registration but it must be signed by witnesses. Now you have right to sue for specific performance of the agreement and in the alternative for recovery of damages and hope you will succeed a person who back out from an agreement is not a appreciable person
