Want to transfer property to elder brother -- is Sale deed mandatory?

Hi, I have purchased a flat in Nasik three years ago. Me as primary applicant of Loan and my elder brother as secondary applicant. The flat is registered in my name though. I wish to transfer the flat to elder brother along with Loan. Consulted a lawyer and he said before we proceed, I need to produce sale deed document. However, I don't have it yet since the builder doesn't have it ( 2 flats are yet to be sold out in the building, this could be the reason) What should I do in this case? Is there any alternate way so that I can transfer the property and loan both to my brother ?

This is my respone to you:
1. How can you not have the sale deed?
2. It is the most important document;
3. You must obtain the same and then register it;
4. Then in future you may transfer it to your brother;
5. Or before registering it on your name include your brother's name as well;
6. Consult a local lawyer and take steps.
