Want to take a housing loan but house under a legal suit

The house i currently Live is ancestral land which was partitioned during my Grand Parent Time among their Siblings. My Father filed a Case in Court stating that we need to get extra land as per Partition Done. All the entire Land of 21 cents which is under case is under one Survey number. In this a part of Patta land of 4.5 cent which was in my Fathers name was gifted to my name by my Parents. This land which is gifted to me is also under same survey number with the actual 21 cents. Now I my Father died so I am waiting for getting legal heir certificate to continue the Partition Suite and I am also planning to demolish the house I am living currently which is in the Land gifted to me and construct a new House. For this I need to apply for Housing Loan. So can someone please suggest whether I can proceed applying for Housing Loan and construct house without any legal problems. As the House I live currently is very old and in the verge of falling apart.
From the facts presented by you, your father had gifted you his share of the ancestral property, following a partition during your grandfather's time, which is in your possession and enjoyment, and now you wish to construct a new house over that property.
