Unregistered will..............................
02-Jul-2023 (In Property Law)
My grand father and grand mother had written a will in 2009, my grand father had mentioned to sell particular property and make a trust on his name. My grand father and grand mother passed away, the property which was on my grand mother's name was sold an year ago and no trust was made from the amount of sale. Now is the will valid.
You can set aside the sale on the ground that the will of the testator had a intention to create a trust and not to give in a private interest to anybody. The validity of the will can be questionable in any legal proceeding.
