Transfer of Property in the event of death

1. Property is in the name of 3 Persons (Mother , Bother and me). Agreement to sale is done 10 years back but not the sale Deed. 2. My brother expired on Jan 2018. 3. Can the Property be transferred to my name if my mother gives NOC? OR do I need to take NOC from my Bother's wife as well?

As per Your Question :

1. Yes. If mother ready gave you NOC for transfer of property , then you have not any objection to transfer such property .

2. Yes. Brother's wife NOC is also mandatory for avoiding any future objections .

3 . After that 2 NOC / Release deed of mother & brother's wife , then you can easily transfer that property in your own name .

Note . 1. Please, At the time of NOC making then it is Notarised & Make affidavits of both .
2. If making Release Deed then it is mandatorily registered .
