The land of my house being transffered to previuos owner's son

Me and my family have been living in my house for 32 years in Bhiwandi, Thane, Maharashtra which was built by my dad on the land that he purchased (by doing complete procedures in local offices) from the previous owner who is now dead (the land was transffered to my dads name in local offices in Bhiwandi). 5 years ago the previous owner's son filed a case in court claiming he was the owner of the land. He never showed up in court and the case was put on pending. But i recently learned that he has transffered the land that my house is currently standing on to his name. By going to some higher offices in Pune and showing previous/old papers (7/12 utara) and claiming he was the rightfull owner through ancestral property/inherited property. I am planning to build a new house on that land after demolishing the old one in 2-3 years. What do i do now!? Plz help...

As per your query,

Firstly you need to appear in the court wherein previous owners son has filed the suit and defend the same by putting up your case how your father became the owner of the property.

Secondly you can need to collect all the documents with respect the said property showing that your father was the owner of the said property. Also collect the 7/12 extract, mutation entries, gut book nakasha (this documents shows the actual design of the concerned land.)

Thirdly if the previous owners son has sold the property to any third party you need to seek cancellation of document.

If you are planning to build the property you need to obtain permission from the local authorities i.e. Municipal authorities.
