Tenant not leaving property

My tenant who has medical shop on rent, is not leaving even we are giving 3 months notice, though rent is paid regularly which is very very less, but we need him to leave as we need shop for our personal use and that shop is front part of our house, he is tennat from last 35 years, we have agreement also, tenant is saying do whatever u have to do we will not leave and the case we will stretch for 5 years, what are our options and if gone to court, hoe long it will take and at the end, we will get our poperty back ?

You already give notice to tenant now you may file suit under rent control act and legally evict the .

it take around 5-12 months further it depends on the lawyer how he proceed.
