Tenant not evicting my shop, lease expires

I have a shop in Mumbai which I had given on lease to a person. Since the start ,he is defaulting his payments , the lease got expired since 12 months and he is conducting business without any lease agreement ,he is giving us monthly rent but not on time. I have warned him verbally to vacant my shop, he is saying that he spent 50000 ruppes on interior and he wants that money before vacating , since a week he has kept the shop closed .I have a new tenant who is willing to take my shop ,can I break the lock and keep his stores outside ??? I want a quick solution for this ..

Do not attempt to break open the lock, it may further escalate the issues and lead to penal consequences. You need to approach civil court and obtain such suitable orders. Once you obtain interim orders, you can induct the new tenant.
