Succession after joint property owners' death
11-Nov-2023 (In Property Law)
Three flats is in the name of my father and uncle. Both died. My uncle left behind his wife without any child. My father left behind me and my mother. They have five sisters. We have been looking after the property since 15 years. After my widow aunt's death, can I make a partition deed in me and my mother's name?
Sir
The property was in the name of your father & uncle. After the death of your widow aunt the property will divorce among the 5 sisters of your father also.
So, the conception that you and your mother alone will get the share is not correct.
