Share of married girl child in father's property
14-Jan-2023 (In Property Law)
My grandmother gave an old house by gift deed to my father. My father gave some amount to my uncle, that is,his brother to settle his share and get the house in his name. So now my uncle is out of question in this property. I even have two aunts(my father's sisters) who r married and have grandchildren. Now since my father is retired, loan was taken in my brother's name and 4floor house was constructed. Two floors are rented and other two(duplex) r for us. I am staying with my mother, father, grandmother, brother and sister in law. Now since loan is taken in my brother's name and I have signed the required papers for it so that he can avail loan, will I have any share in this property now and in future if my parents die? Will my aunts have any share in this property? I am married and I work in a bank. I am Hindu.
Once registered gift deed executed in your father name, then you father is absolute owner of that property. Your father is fully right over that property. Your father can transfer that property by way of sale, gift, to any time during his life time. If your father died without any will, then only right flows to his wife and children.
