My grandfather purchased a DDA flat in 1986 and he passed away intestate in December 2000.My grandfather had four legal heirs. After that the property got transferred in the name of my father and my uncle in 2004 through a Relinquishment Deed. But of late i have developed some personal differences with my father. Now can I or my sister have any legal claim over our grandfather's acquired property.

Query perused. Once the property has been mutated in your fathers name it becomes a self acquired property and he can bequeath it to anyone of his choice thru a will. You or your sister perse can't claim. Your father can give it to you through Will or gift deed.

Whether grandchildren have a right to their grandfather’s property depends upon whether such property is joint family property or the self-acquired property of the grandfather. If the property is joint family property (HUF property) the grandchildren would also be entitled to a share depending upon the number of members or coparceners of such joint family. However, in the case of self-acquired property of grandfather, no such right vests in any person much less grandchildren to inherit the grandfather’s property.

Hello sir i have perused your query. In the circumstances where the property is self acquired in nature, the right in the property of a daughter or a son does not lie. Therefore you can not claim anything out of the said property unless you've contributed in its purchase.
