Seller refuses to return token money

Hi Sir/Madam, I have given a token amount through cheque to Seller for purchasing his flat situated in Mumbai. But after receiving property documents and his personal documents, I came to know that Seller's wife got expired and they are having a minor child of age 14years of old. So I asked him for a legal heirship certificate or Guardian certificate but he refused to provide me the same. Now I asked him either to provide me the required documents or return my token money. But now he is refusing to return the token amount. Please suggest to me what I should do.

as you have paid the amount through cheque you can file recovery suit for the recovery of the token amount. you can still purchase the property on the basis of affidavit that the husband is the guardian of the children for further details you can call me
